These Terms and Conditions ("Agreement") govern your use of the Smart Rakhi software ("Software") provided by Rinu Rakhi ("Provider"). By accessing or using the Software, you agree to be bound by this Agreement. If you do not agree to these terms, please refrain from using the Software.
License and Use:
  • 1.1. License Grant: Provider grants you a limited, non-exclusive, non-transferable, revocable license to use the Software for personal or internal business purposes in accordance with this Agreement.
  • 1.2. Restrictions: You shall not, directly or indirectly:
    • (a) Copy, modify, or distribute the Software;
    • (b) Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software;
    • (c) Use the Software for any illegal, unauthorized, or infringing purposes;
    • (d) Interfere with the security or integrity of the Software or its data; or
    • (e) Remove or alter any proprietary notices or labels on the Software
  • Beta Phase and Disclaimer of Warranty:
  • 2.1. Beta Phase: The Software is currently in beta testing phase and may contain errors, bugs, or other issues. You acknowledge that the Software may not function as intended in extreme scenarios.
  • 2.1.1 Thorough Testing: We have made best efforts to thoroughly test the Software for errors and bugs before making it available. However, due to the complex nature of software development, it is possible that some errors or bugs may still exist.
  • 2.2. No Warranty: The Software is provided "as is" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Provider does not warrant that the Software will be error-free or meet your specific requirements.
  • 2.3. Issue Resolution: In the event that you encounter any issues while using the Software, please report them to our support team at [support email address]. We will make best efforts to investigate and resolve reported issues promptly.
  • Third-Party Services:
  • 3.1. The Software may integrate or rely on third-party services or components. Provider shall not be responsible for the availability, functionality, or quality of such third-party services. Your use of any third-party services is subject to their respective terms and conditions.
  • Intellectual Property:
  • 4.1. Ownership: Provider retains all right, title, and interest in and to the Software, including all intellectual property rights. This Agreement does not grant you any ownership or rights to the Software, except for the limited license explicitly provided herein.
  • 4.2. Feedback: If you provide any feedback, suggestions, or ideas regarding the Software, you grant Provider a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, modify, and incorporate such feedback into the Software without any obligation or compensation to you.
  • Limitation of Liability:
  • 5.1. To the maximum extent permitted by applicable law, Provider, its affiliates, directors, employees, agents, or representatives shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the use of the Software, including but not limited to any loss of data, profits, or business interruption. However, nothing in this Agreement shall exclude or limit liability for damages caused by Provider's willful misconduct or gross negligence.
  • Governing Law and Jurisdiction:
  • 6.1. This Agreement shall be governed by and construed in accordance with the laws of Kolkata . Any disputes arising from or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts located in Kolkata.
  • Severability:
  • 7.1. If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
  • Entire Agreement:
